1. Contracting Parties:

This agreement is made between:

• Advertiser (Property Owner):

2. Subject of the Agreement:

The Website Owner allows the Advertiser to advertise their property on the njhomes.eu website under the following conditions. The property advertisement is free of charge if the Advertiser agrees to pay a 3% commission to the Website Owner from the sale or rental price in the event of a successful sale or lease. If the Advertiser does not agree to the 3% commission, the advertisement fee is not predetermined, but will be agreed upon by both parties, and the Advertiser is obligated to pay this fee.

3. Advertisement Content:

The advertisement must include:

• The type of property (e.g., for sale, for rent, etc.)
• A detailed description of the property (e.g., number of rooms, floor area, room layout, features)
• Pictures of the property (if available)
• The property's location (town, address, area)
• Contact details (e.g., phone number, email)
• The price of the property (if relevant)

4. Advertisement Duration:

The advertisement will be published free of charge if the Advertiser agrees to pay a 3% commission from the sale or rental price in the event of a successful transaction. If the Advertiser does not agree to the 3% commission, the advertisement fee will be determined based on mutual agreement, and the Advertiser is required to pay it. The advertisement will remain published for a pre-determined timed agreed upon by both partners previously, unless the Website Owner decides to remove it.

5. Advertisement Terms:

The Advertiser ensures that:

• The property is truly for sale or rent, and the information provided in the advertisement is accurate.
• The advertisement complies with legal requirements, the Website's guidelines, and does not contain offensive, illegal, or false information.
• The property is legal and complies with all applicable laws.
• The Advertiser has exclusive rights to sell the property and has obtained all necessary permissions for the advertisement.
• The Advertiser agrees to pay a 3% commission to the Website Owner from the sale or rental price in the event of a successful sale or lease, if the advertisement is free.
• If the Advertiser does not agree to the 3% commission, the advertisement fee will be determined based on mutual agreement, and the Advertiser is required to pay it.

6. Deposit for the 3% Commission Option:

If the Advertiser chooses the free advertisement option and agrees to pay a 3% commission from the sale or rental price in the event of a successful transaction, the Advertiser is required to provide a deposit (advance payment). The deposit will be refunded if the sale or lease does not occur, or if the agreement is terminated before the transaction. The amount of the deposit will be determined by the Website Owner and must be paid by the Advertiser in advance. The deposit will be credited toward the 3% commission after a successful transaction.

7. Modification of the Advertisement:

The Website Owner reserves the right to modify the content of the advertisement if necessary, should it not comply with the website's guidelines.

8. Liability: The Website Owner is not responsible for the accuracy of the properties listed in the advertisements or for any consequences arising from the advertisement. The Advertiser is fully responsible for the truthfulness of the information provided in the advertisement. The Website Owner is entitled to receive a 3% commission for a successful sale or lease if the advertisement is free of charge.

9. Termination of the Agreement:

The Website Owner may remove the advertisement at any time if the Advertiser fails to comply with the terms of the agreement or if the advertisement becomes legally problematic for any reason.

10. Other Provisions:

This agreement only pertains to the publication of the advertisement and does not cover any other services. Any other agreements must be documented in a separate contract.

11. Commencement of the Agreement:

This agreement becomes effective upon the Advertiser’s acceptance by checking the checkbox at the „Agree to terms of advertisement:

The Advertiser confirms, by ticking the checkbox, that they have read, understood, and agree to the terms of the Real Estate Advertising Agreement, including the 3% commission payment in the case of a successful transaction, and that they will pay the required deposit. If they do not agree to the 3% commission, the advertisement fee will be determined by mutual agreement between the parties and is required to be paid by the Advertiser.

After submitting the form and accepting the terms, the Website Owner will contact the Advertiser soon for further discussions and to finalize the advertisement details.
